These Terms of Service ("Terms") govern your access to and use of romanactivewear.com and any related services (the "Site"), operated by Roman Activewear ("Roman Activewear", "we", "us"). By accessing or using the Site, or by placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to make a purchase. By placing an order you confirm that the information you provide is accurate and that you are authorised to use the payment method supplied.

Products, Sizing and Colour

We work to display our products as accurately as possible. Colours shown on your screen may vary depending on your device and display settings, and slight variation between production runs is normal for dyed garments. Product images are representative; small differences in fit, finish or shade are not considered faults. Please refer to our size guide before ordering.

Availability, Pricing and Errors

All products are subject to availability and may be withdrawn at any time. Stock levels shown on the Site are updated automatically but may change between the time you add an item to your cart and the time you check out; adding an item to your cart does not reserve it. We reserve the right to limit quantities per customer or per order.

We make every effort to ensure pricing is accurate. In the event of an obvious pricing or description error, we reserve the right to cancel any affected order, whether or not it has been confirmed, and to refund any amount charged in full.

Orders

Your order is an offer to purchase. An order confirmation email acknowledges receipt of your order but does not constitute acceptance. The contract between us is formed when we dispatch your order. We reserve the right to refuse or cancel any order, including where we suspect fraud, unauthorised or unlawful activity, reseller activity, or abuse of a promotion.

Payment

All prices are in US dollars. Payment is taken at checkout through our payment providers. We do not store your full payment card details. Applicable taxes are calculated and shown at checkout.

Discounts and Promotional Codes

Discount codes are valid for a limited time, may be withdrawn at any time, and may not be transferred, resold, or exchanged for cash. Unless expressly stated otherwise, only one discount code may be applied per order; a discount code may apply on top of an existing markdown where our system permits it. We reserve the right to cancel orders where a code has been used in a manner it was not intended for.

Shipping and Risk of Loss

Shipping options, rates and estimated timeframes are set out in our Shipping Policy, which forms part of these Terms. Title and risk of loss pass to you upon delivery to the carrier, subject to any carrier insurance applicable to your chosen shipping method.

Returns and Refunds

Returns and exchanges are governed by our Refund Policy, which forms part of these Terms. Please read it before ordering, as it sets out the condition items must be in, the time limit for returns, and which items are not eligible for return.

Customer Content and Tagging

If you tag us, mention us, or use our hashtags on social media, you grant Roman Activewear a non-exclusive, royalty-free, worldwide licence to repost, reproduce and display that content on our Site, in our marketing and on our social channels, with attribution to your handle, until you ask us to stop. You confirm that you own or have permission to share the content, and that everyone shown in it consents to this use. To have content removed, contact us and we will take it down promptly.

Any reviews, comments or other content you submit must be your own and must not be unlawful, abusive, deceptive, or infringe anyone else's rights. We may remove content at our discretion.

Intellectual Property

The Site and all of its content — including the Roman Activewear name and logo, product designs, photography, text and layout — are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, resell, or use our content or branding for commercial purposes without our prior written permission.

Acceptable Use

You agree not to use the Site to break any law, to interfere with its operation or security, to scrape or harvest data by automated means, to attempt to gain unauthorised access to any account or system, or to introduce malicious code.

Third-Party Services and Links

The Site is hosted by Shopify and uses third-party services for payments, shipping, analytics and marketing. The Site may link to third-party websites. We are not responsible for the content, policies or practices of third parties, and your use of their services is subject to their own terms.

Disclaimers

Our products are intended for general athletic and everyday use. The Site and all products are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms excludes or limits any rights you have under applicable consumer protection law that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Roman Activewear will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenue, arising out of your use of the Site or any product purchased through it. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Indemnity

You agree to indemnify and hold harmless Roman Activewear and its officers, employees and agents from any claim or demand arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute will be brought exclusively in the state or federal courts located in Galveston County, Texas, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time you place an order is the version that applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
